Clean Water Laws

Carstens, Black & Minteer (CBM) has experience with the federal Clean Water Act and our California Clean Water laws.  CBM represented the states of New York and Connecticut in suing the Environmental Protection Agency (EPA) to require promulgation of effluent limitation guidelines that would apply to the construction and development industry pursuant to the Clean Water Act.  The district court issued, and the Court of Appeal upheld, an order requiring the EPA to promulgate the guidelines.  (Natural Resources Defense Council v. U.S. E.P.A. (2008) 542 F.3d 1235.)  CBM also addresses water quality issues through the requirements for streambed alteration permits, Army Corp of Engineer permits, and other administrative procedures, and has raised water quality issues before Regional Water Quality Control Boards.
