Coastal Act

Carstens, Black & Minteer (CBM) has litigated under the Coastal Act on several occasions, including challenging a residential development in Ventura on Ecologically Sensitive Habitat lands and development of wetland areas in Los Angeles.  CBM is currently litigating against the Coastal Commission for approving filling of wetlands at the Del Mar Fairgrounds by the 22nd Agricultural District.  CBM has also challenged the City of Huntington Beach's approval of permits for a residential development that will adversely impact environmentally sensitive habitat areas and unique archaeological resources above the Bolsa Chica wetlands, in violation of both the California Coastal Act and the California Environmental Quality Act.  

In addition to enforcing the Coastal Act, violations of certified Local Coastal Programs approved by cities and counties can provide the basis for legal actions.
